Nexus 5 Stolen After Delivery - Nexus 5 General

Got 2 phones, 1 for me and one for my Girlfriend.
They arrived Friday.
Hers was stolen today from a local college.
I called T-MO and had them blacklist The IMEI
Is there any recourse I can take through Google?
I called them but it seemed they were only familiar with UPS as the theif.
I had text'd the phone telling the person I would pay a cash reward for the return or they could turn it in to Lost and found. But they turned the phone off half hour later.
Keep your eyes out for any too good to be true deals.
Any advice or direction is greatly appreciated.

Amex didn't cover anything.
T-mobile claims They cant block it because it was purchased through Google.
Google says they cant do anything after the phone was "Activated" although All we did was put in a sim and turn it on.
So basically a big F You from google
I WILL NEVER BUY A GOOGLE PRODUCT EVER AGAIN!
Basically if you bought a phone from google as soon as you open the box Anyone can steal it free and clear.
There is No recourse possible. You cant block the IMEI. Nexus Devices are Gold Mines for theifs. Steal it Factory reset it and you got yourself a free device.

That SUCKS. Google can do nothing for you, my best advice would be to report it stolen to your local authorities. Make sure to give them the serial number and stuff so they can verify that it's yours if they find it.

Check with the credit card company that you used to pay for the phone, I think they have some kind of purchase protection within 60 or 90 days.

I don't know anything about it, but I saw a feature called android device manager. Both my nexus 5 and my old phone show up on this site:

Did you try using the Android Device Manager to locate it before contacting the thief? Or was she not able to even open the box to register it?

He would have had activated that feature from the phone in order for it to work...

Thanks Ill Call AMEX Tonight and see what kind of protection they have. I always use amex because they are pretty good about purchase.

Actually I called google first, They directed me to my carrier. All google will do is Blacklist The IMEI if its stolen in transit. I asked and pleaded with the google support guy who was very sympathetic but he said there was nothing they could do.
I had my girlfriend "Ring" the phone from google devices. hoping the guy is in class and it makes a big scene.
She also then "Locked" the phone via Google devices.
I really appriciate all the input guys. I actually dont feel so screwed over even though it still sucks. Having NO recourse is like the absolute worst!

A few things:
1) You should always have a lock on the phone (ALWAYS). It's simple to put a password or pattern unlock on the phone and it pretty much completely prevents someone from using the phone. It's still possible to reset the phone, but it's much more difficult for the average thief (too much so to make it worth it).
2) Activate Android Device Manager immediately after turning on any Android phone for the first time. It'll let you track the phone, ring it loudly if you need to, lock it remotely (and permanently), and wipe it, if necessary. It's the best built-in protection possible, and it works really well.

Hindsight my friend. This is the first phone I or her have had stolen.
I already activated it on everyone I knows device. And its only been 14 hours :good:
Phone was out of the box, Literally the first day she left the house with it is when it was stolen.

To the OP, it's an awesome thing that you used AmEx for the purchase as they have incredible benefits. Their purchase protection is second to none (Up to $1000 per incident/$50,000 per year). It's also good you've filed a police report, since you'll need the report number.
1) Call 1-800-322-1277. That's AmEx's purchase protection department.
2) File a stolen item report with them. They'll ask for the supporting documentation or info from the police report.
3) Once they've done their stuff (usually a couple business days) you'll have the funds credited back to your card.
I always use my AmEx for important/expensive purchases just because of this benefit.

Nobody said google was at fault.
So here is a horrible update...
I called google initially to report it stolen so they could blacklist the IMEI, Google said they couldnt help so I should call the carrier. I called Tmobile and they claimed they were blacklisting it. a day and a half later nothing is done.
I call Tmobile again and this time they claim they cant do anything since the phone wasnt purchased from them.
So Im pretty upset at this point I try calling LG and they cant help me.
So I call google back Yesterday Friday the 15'th and the CSR tells me there is nothing they can do.
At this point Im Enraged. How can they let this fall through the cracks?
If it was an Iphone it wouldve been HANDLED that day.
But I get the bounce around and now its Saturday and the phone still isnt blacklisted.
Basically googles Inability to Do anything has allowed the theif to either sell it or trade it in for money. basically ensuring I never get the device back.
To make matters worse My Amex is a Bank of america AMEX and people are saying it doesnt have purchase protection only warranty extension.
So at this point I cant get anyone at google to help me. Ive called 6 times, Been referred to 2 specialists and basically told that there is nothing that can be done. Google is telling me they cant black list phones and so I should just deal with it.
I find it unacceptable and I am looking for a way to voice my disdain for google customer service.
They really botched the situation.

This could have been handled on the spot.
If anyone has any information that could help. Even google corporate contact information it would be nice.
I will never buy another product from google after all this BS.

Sorry for your issue, but Google has no play whatsoever to 'blacklist' an IMEI. Carriers do that. If TMO refuses, there is nothing else to do/say about it. You need to focus on getting your money back.

Lost and Found Moral Issue

I lost my tilt a couple of days ago only to find it today after already calling it in to replace it under my warranty. My problem now is I already paid the 50 dollars to replace it. Should I send it back or give it to my brother who is begging for it. Can the company see that he will be using my "lost" phone even if he has his own sim card. Thanks for any advice.

Yes.
Don't know where you're living, but in E.U they can block IMEI in the whole system. You also may involve in insurance fraud, too.
To my opinion, you should call the company to check if they want you to do, and don't forget to ask back the deduction fee if they tell you to send it back.
My phone's service was turned off and will be reactivated once the new phone arrives with my new sim card. But what my brother wants to do is put his sim card in my old phone so he can use it that way. but that seems pretty shady to me. I don't want to get in trouble with my phone company. Should i let him do it and just use the phone they send me or just return it? I already paid for the new one, so is it wrong?
if they have blocked the IMEI number (most do when a phone is reported stolen / lost) then your brother will not be able to use it.
also if they catch your brother using it you (and your brother) can be done for a few reasons:
Insurance Fraud
Using stolen goods (knowing they are stolen)
etc
so to be honest id just phone them and see if you return the phone if they can reverse the charge. alot less hassle than paying fines etc in the near future
You probably won't get away with it..
But if you could - by all means, screw the insurance company as hard as you possibly can.
Not that I advocate this behavior at all, but I have been in a similar situation and had no problem using a previously thought lost device with a different sim on what used to be Cingular.
Under what warranty did you replace it?
You agreed to ship the phone back to them if you did find it. There's instructions that come in the box. But whether or not you do it is up to you.
Two options -
A. Ring up the company and see which they want back, OR
B. Don't.
If you go with A. you might get your money back, but I doubt it. I also doubt they will let you keep both.
If you go with B. you will be comitting fraud and if caught you will be in legal trouble and I will have no sympathy for you. If your brother wants a tilt, he can go buy his own, do NOT give him the spare or you will be putting a LOT of trust in him. Do NOT use it as a phone or otherwise allow it to be used as a phone - it will get traced which will lead to legal problems.
Realistically, you should go with A. - it's the right thing to do, it's less risky and the handset should effectively be useless to you anyway.
I love how you title this as a moral issue, but your only question is if the company can find out about it. Doesn't sound like you have any moral concerns but rather "will I get caught" concerns.

Call them. There is such a thing as Karma, if you don't call them you very well might really lose it and they won't give one back.
Regarding moral issue - this is EASY PEASEY - trade places - you are them and they are you - should THEY return it to you? You reported it stolen/lost - they replaced it you no longer own the other one - you must send it back.
Another analogy - you call your insurance company and say you have filed a police report that your car was stolen and then find it in your garage - can you cash the check and get another car and drive two of them? Nope - you are going to get caught filing a false report to the police and do some serious jail time.
The IMEI number is unique to the phone - you are going to get caught if you play fast and loose - don't pretend that it is a moral issue when you only want to know if you can get caught.

I guess it really depends on who your service carrier is.
If its ATT/Cingular, I wouldn't return it. I'm almost 100% sure that they can track what phone you're using but not the IMEI number of that phone. The reason I say this is because I have a habit of switching or getting new phones every few months. I purchased the Tilt used from a HoFo member. I recently had problems with it and had to RMA it. They asked me for me IMEI number and I had a feeling it was past the year mark but they said that it looks like you've only had the phone since Sept so it would be covered under warranty. The thing is I got the phone from the HoFo member in Sept, but he said he had been using it for a few months prior to that.
But I could be wrong. You could always call ATT/Cingular and just be blunt about it and ask them if they can track your lost phone via IMEI because you have an idea of who might have it.

For all our European counterparts. In the E.U. it is very much illegal to use a "stolen" or "lost" phone. They also block IMEIs and CAN track them. For the life of me, all I've been able to find about whether the cell phones companies track or block IMEIs or phones is that we don't do it here the US. At&t and at&t's insurance companies have told me is "sorry, we can't track or block the phone from being used again." To me, the reason is obvious. If the phone is stolen, at&t gets a new customer and you have to buy a new phone.
You make your own decision and you make it at your own risk but search away and maybe you'll find the answer you're really looking for.
I doubt you'll spend the rest of your life in prison..... Hell maybe.... If you really feel bad about ripping off a mutli-billion dollar corporation that is already ripping you off. Huh.... Tough choice....
Ring the carrier, tell them to cancel warranty replacement as you have found the original and to refund you the $50 and reactivate the existing phone with either the old or new sim card. I believe under your statuatory rights (at least in the UK anyway) they would have to oblidge as you have the right to cancel a service (in this case the warranty replacement) within a reasonable amount of time.
Try it and save yourself $50 maybe....
This is no moral dilema at all. Just ask yourself "What Would Jesus Do?"

So United has a horrible Lost and found system. I called them less then 30 minutes after walking off the plane. I wanted someone to walk to my seat and physically grab it. Since i was near the rear of the plane and the last one out of my row im pretty sure no other passenger would of grabbed it. All they could do is basically tell me to report it on the website and i "might" get a call. The thing is I know and have talked to a few flight attendants and it seems like a lot of the time there co-workers hide the stuff and keep it for themself. So instead of united actually doing a physical check it is pretty much as good as gone at this point. I really have no faith i will get it back. It was a flawless N7 16gb too!. Doubt I will buy a new one to replace it even though i really loved the device, I just have too much other things going on to afford it atm. So if I dont get a call/email in the next few days, it was nice being a part of these forums and loved the vibe here.

This reminds me when I lost my old GBA case on a plane. It had so many good games in there, and the GBA itself. I still had my SP case though, that had the SP and games as well, so I didn't lose everything.

Get a case or sleeve that you can tether to your bag, belt, etc. Also, Case Logic LNE07 comes in red so it's hard to visually miss it.

United Airlines is the worst. From the most cramped planes with the worst seats in the industry, to the worst customer service there is. I used to fly Continental exclusively, but since the merger, no more. Good luck.
Any chance you had Lookout or some other tracking service installed? Sucks man. My wife is a flight attendant and she has turned in several Kindle's and what-not in, so perhaps there is a chance. Best of luck!

You never know, I found someone's kindle on a Southwest flight and took it right up to the counter. They said they had already hear from the passenger and knew whose it was. Messing with other people's gadgets is bad mojo.

Can you tell if it's still at the airport? If yes, that is a very good sign that it's probably been turned in (and someone turned it on and connected to wifi...but lets hope that was in an effort to identify you for good reasons). If it pops up online anywhere outside of the airport...it's pretty much gone. Hopefully you changed all your passwords to all your accounts too...notified any credit cards you have tied to any of those accounts, etc.

If you bought it with a credit card you might have some buyer protection like, replacement for stolen or broken items. I buy everything with American express, I have a 90 day window in which they will replace if lost, stolen, broken, etc.... Plus they extend any warranty an additional year...
Visa has something like this on a few of the cards...

you need to input your passcode anyway, unless you have it stored in your tablet for someone to find out
I am really surprised that Google doesn't have an easy way to register our devices. Every Android device has numbers associated with it that can't be changed. The MAC addresses for both the WiFi and Bluetooth interfaces are unique, so every device that has either of these radios could be identified. It should be part of the OS that these tablets can't install any software if the registered owner reports it lost or stolen. If the device has cameras, a picture should be taken when it's connected to the internet. These pictures could be retrieved when a valid case number or subpoena is provided. At least a warning should appear on the tablet saying it has been reported lost or stolen. Make it a pain to use a misappropriated tablet.

Someone on another thread said that somebody sold them a Nexus 7 that was apparently known to Google as stolen, and I guess Play access was disabled or something, I don't know the exact details though...
An app is only easily removed if it is loaded as a user app. If it is am system app a standard reset went be enough. On the other hand maybe they will be smart enough to take it further.

A very similar thing happened to me on a BA flight inbound to heathrow years ago. On that occasion i left a case containing some sennheiser noise cancelling headphones and an ipod nano in the seat pocket. I realized just a short distance from the gate and went back but they wouldn't let me back on. They never found for me either. I was eventually told that "I think someone has add it mate".

I have my devices set to take front and rear photos on evey boot and on multiple incorrect passcodes which are uploaded staight to dropbox and google plus. They also text each other with gps coordinates on every boot. Again, this is only useful if the thief doesn't factory reset or flash a new rom.
I wonder if devs could implement a passcode for cwm et al to secure the flashing process?

I read on Google's help pages that they can remotely lock a device so might be worth calling them. If someone can't use it they might put it back in lost property or something.

Is it OK to complain about Motorola service?

I know this is about the PHONE...but its quality and likableness have been dramatically reduced by the awful Motorola customer service. Thus far I have yet received one workable solution. On the phone they normally kick me to another department or play some robot answer. Customer service has been absolutely horrible for quite a few people.
They really need to train the call center people better, give them more power to solve problems.
Never promise to call someone back. Putting them on hold until someone can get on the line to solve the problem is always better.
Good customer support is becoming more and more rare these days. I think the only people who have been helpful is the GoDaddy phone support... and support for a Wordpress plugin called Nimble Porfolio. They're awesome. Everything else has been so disappointing... AT&T, Motorola, Google, etc etc. You name it, chances are their customer support sucks.

Looking into my wifi issue, they asked if I had another phone I could talk to them on while I wiped the cache partition. When I asked if they could call me in an hour (I had no idea how long it would really take me and was growing tired of their BS) they said I had to call back.
Granted this was after I almost ripped level 1's head off because my cat had accidentally run across the keyboard, deleting the reference number and they couldn't find it again and actually admonished me for losing it. ("If you had kept the number you'd already be talking to level 2 sir")
I've given up on Moto support, just going off what I find here.
Oh and the chat said the Idle Battery Drain issue was "Common to all Android Phones"
I agree with you guys customer service has been horrible. I ordered my Moto X through Moto Maker on the 1st and recieved my phone on the 5th. Which was awesome except the phone they sent me was defective. The touch screen would not repsond to touch. I actually am not able to turn it off (It's still on right now) I called customer service and they did not believe me that the phone was bad right out of the box and they asked me if i dropped it and asked me to reboot and do all sorts of stuff to the phone even though I kept telling them the touch screen was not responsive. They finally gave me 2 options the fast way or the slow way. They said I could pay full price for a new phone and send back the defective one and once they got that they would refund me. My second option was to mail back my new defective phone and wait a week or 2 until they send me the new code to order another phone. After I told them I'm not sure of their quality anymore the operator assured me the new phone they were sending me would be guaranteed to work. I asked why my first phone wasn't guaranteed to work she politely informed me that they were still not sure if it didn't work and that I may not know how to use my phone.
This customer service experience is sad and I expected more for Motorola besides a $ 25 Google play gift card. Now I'm out $1,000 and still don't have a working Moto X.

The "user is an idiot" is a typical mind set in ATT/Motoland
i can't even begin to describe the scars i have from dealing with their Support. it's chaotic and confusing.

My phone was lost, tracking app has come alive!

Greetings good people of the xda-developers forum!
After a little reading around I figure this is the most apropriate forum to post this thread in, correct me if I'm wrong.
Earlier this year I lost my phone in a cab after a night out, the driver decided to keep my phone instead of turning it in (usually if you leave something in a taxi in this region, you'll have it back with a little humiliation from the taxi-central the day after, not this time though).
A couple months after loosing it, I got a "emergency message" from my lost phone, and it went on and off for a little while untill yesterday when it apparently was taken into use! I have an "invisible" tracking app installed that will survive factory resets and gives me the opportunity to take pictures, record sound and some more.
Anyway, the phone has moved a couple countries away since it was initially lost, so I've lost hope of reclaiming it. My plan now is to give an honest shot at making my phone the most annoying device the new owner has ever had!
I come to this forum now, looking for inspiration/ideas and warning where warnings are due!
Is there anything I really shouldn't do, that could come back and bite me?
What would you do if you were in my situation?
Any good ideas of how to bother this guy?
So far I've only really come up with the idea of wiping his data from time to time..
I appreciate any ideas or warnings!

it will not back bite you if have retail invoice of that phone do whatever you want
Isn't it possible, even with sim card phones, to call your carrier, report it stolen, and have it basically bricked so Noone can use it again. I know they can with like sprint and Verizon phones that don't take sim cards. But I've heard of it happening with sim devices too. I would just try calling your carrier.
If that don't work. I'd leave it alone. The person who has your phone now probably isn't the person who took it. Which is why it was sold out of the country. And that person most likely doesn't deserve all that crap

That's the nasty part of stealing a phone. The Carrier will lock the "ESN" (Electronic Serial Number) so all they need to do is flash it over to another carrier... I.E. if you have a GSN type phone from say AT&T you can flash the software over to T-Mobile who doesn't give a flying flip about a stolen ESN (As a example) I personally have T-Mobile... They did try to make a law making req the manufacture to add a "Kill Switch" allowing the consumer to render the phone useless how ever that did not pass... SO Basically some one steals your phone that's it nothing you can do but buy another phone or hack into it like the OP..
TO OP: I'd go Impractical Jokers Style. Ease drop on him and play really dirty sounds (Porn sounds... moans/grunts etc) then Fry the phone... **** that guy he had to know it was stolen and if he didn't he's a fool... Check your ESN's People!

It is indeed possible, but not flawless. There is supposed to be some automation to it in the country the phone was initially lost, but either this automation failed or it's sucess is the reason it left that country. Problem is though, the idea is that they block the IMEI from the networks, but some countries are not part of this agreement/system.
I think the guy who is currently in posession of the phone knows perfectly well how it was acquired. Judging from pictures taken through the phone, the taxi-driver and the current holder of the phone may very well be related. Also, the phone had it's language changed to Arabic by the taxi-driver, this has not been changed by the new user (not that it prooves anything). There is also the fact that the SIM inserted in the phone in the country I lost it in, followed the phone over to the current country, where it was replaced by what appears to be a prepaid SIM. I don't think this phone was up for sale anywhere, I think the taxidriver sold or gave it away to some family member coming to visit.
As mentioned, I have no hope of having it returned. I'm not gonna push this too far, but I do feel like putting a dent in his joy over his shadily acquired device.

As far as I've understood, in the European countries that are part of this agreement any locked IMEI number will be locked out of all mobile networks, this can only be worked around by changing the IMEI number or shipping the phone off to some country that is not part of this agreement. In the country my phone was lost the police send a notification to the networks when they recieve a lost/stolen report. Not sure if it went through in my case.
My list of options are limited to what my tracking software allows me to do, sadly (or happily, depending how you look at it) my programming skills are not by far sufficient for me to go beyond what the software offers, allthough I reckon someone with the right knowledge could use the tracking software as a backdoor into the device?
Wow. I'll be honest, I never thought them tracking apps would ever give you anything useful, but if your able to basically see every picture they take, take pictures yourself...I think that's crazy... wipe the phone....
What exactly can you do with yours? Read texts sent and received on the phone? Does it gps track its location on demand? Even if the gps is disabled in the device itself?
You said the one you have stays on the device even after restores and factory resets? What's the name of the app?
As for the locked esns.... If an American cell company like tmo locks one up, is that gonna stick over any of the carriers in the US? Basically, all 4 of them?
Cuz I know before, as long as you had a sim card, it didn't matter, you just swapped it for a new one.

I'm using Cerberus. I had the same app installed without root access/without placing it in system/apps on another phone I lost a couple months earlier, in which case it gave me absolutely nothing. This one however, installed in system/apps with root access, appears to be "immortal".
I reckon they will have a comprehensive list of what you can do with the app on their homepage.
I don't know anything about how things are done in the US.

So you bought a nexus 6 from a local seller without checking the device first to see if it was still under contract or stolen?
Call the police and ask them if it has been reported stolen? Contact Google and let the account owner know you have his phone.

How do i contact Google? I don't mind giving the owner his phone back. But I bought it for 150$, how I do I know the owner will give me back my money.

The owner isn't the person who sold it to you, so unless the guys is feeling generous, you are probably out $150. But if you keep it you will be keeping stolen property (likely, as I don't know it was actually stolen). It is a bad situation for you, sorry!
You paid $150 for a 600 or 700 dollar phone and didn't think anything was wrong? LOL
Well you could open up a ticket Google you would have to get on the internet and look I don't know.
I suppose the owner could give you your hundred fifty dollars back as a finders fee but if it is stolen you are in possession of stolen property. I don't know the laws where you live but, I assure you it's not good where I live.

There is a very high probability that the device has been stolen. There is an equally high probability that you are now in possession of stolen property.
You are now morally obligated to report this to the proper authorities regardless of where the intended use of phone may be. Overseas or otherwise.
No one here will help you to try to bypass the security features that are specifically designed for this very purpose.
Do the right thing.
Is there even a way to bypass the new security features without taking apart the device? I was under the impression it was similar to Apple's. Making the device useless for anyone but the original owner or a repair shop.

Let's see, you want to magically bypass a new security feature made specifically for a situation like this?
Original owner locks his phone to his account, phone gets lost or stolen, and someone sells it to you .... now you want into the phone....

OP - Did he show you the phone working? My guess is not as well because it wasn't theirs to sell.
You do have our collective pity, however you only have the option of getting hold of the seller, whom IMHO isn't the owner. Or if that slight chance exists, then he goes in and removes his account (which should have been done in the first place before selling - another indication their bogus)

Thank you for your opinions. I'll take that in for consideration. Morally ....hummm....that's depends on good days or bad days... sometimes it's get lost and had to be found again.... I have lost the moral thingy ....somebody found it on the street ....go sell it to another person....i guess it's now another person moral have to obligated to return my moral to me....sigh...

Your personal morality aside, you won't find anyone here to help you. The phone is functioning as it should once it is lost or stolen. To otherwise bypass is against the EULA, as well as criminal in certain parts of this world.
Just. Wow. You are in possession of stolen property from the looks of it. This is a crime in most places around the world!
And, no, this has nothing to do with "morality" but everything to do with ILLEGALITY! You're in ILLEGAL possession of someone else's STOLEN property. Return it to them immediately!
